Appellate Practice
Appeals require great attention to detail, a firm understanding of legal concepts, mastery of the procedural rules of the appellate courts, and the ability to persuasively articulate the issues through legal writing and oral argument. Our firm has handled appeals before the Arkansas Court of Appeals; the Supreme Court of Arkansas; the 8th Circuit Court of Appeals; and the United States Supreme Court. Our appellate attorneys have been appointed by the Supreme Court of Arkansas to help draft rules pertaining to appellate practice; authored chapters and model briefs for the Handling Appeals in Arkansas Manual; and regularly teach continuing legal education courses to other attorneys on appellate practice and legal writing.
Banking
Banking relationships can be quite complicated and give rise to several legal issues. These issues include collection actions, foreclosure proceedings, lender liability suits, and workout arrangements. Our firm has a full range of experience with respect to the legal issues arising from banking relationships.
Class Action Litigation
Class actions are unique because of the scope of the proceedings and the representative nature of the named plaintiff. Class certification and discovery issues predominate in the early stages of these cases and are often determinative of the outcome. Our firm has been involved in numerous national class actions and other group litigation matters (such as federal multi-district litigation) representing national and international corporations.
Commercial Litigation
Our firm has handled a wide-range of commercial litigation matters, including employee-employer relations, business contracts, covenants not to compete, and other transactional matters. These matters tend to be complex and require expertise in business as well as law.
Contract Disputes
Our attorneys regularly draft, interpret, and litigate contracts. We have handled cases involving breach of the contact, declaratory judgments, injunctions, and contract interpretation.

Domestic Relations
Our firm handles a full range of domestic relations issues on the trial and appellate level, including divorce; child custody; visitation and support; adoption; alimony and spousal maintenance; modification of previous court orders and awards; prenuptial/premarital agreements; paternity; restraining; and protective orders.
Estate Planning, Probate, and Trusts
Our firm works with individuals to meet their estate planning needs. This work includes the drafting of wills, trusts, power of attorneys, and living wills. We are also experienced in handling the probate of estates, which generally includes collecting a decedent’s assets, classifying and paying approved liabilities, paying necessary taxes, and distributing of property to the heirs. We have also represented a number of clients in will contests and other estate-related litigation matters. We have specific experience in representing clients in trial and on appeal involving disputes arising from the administration of trusts.
Insurance Defense
Our firm is recognized as a major litigation firm in the area of insurance defense and excels in all aspects of insurance law and litigation. We have handled not only personal injury claims but also insurance fraud cases. We have represented insurance companies in cases involving staged car accidents, arson, and fraudulent theft claims.
Insurance Coverage and Bad Faith
The attorneys in our firm have experience reading and interpreting automobile, general liability, homeowner’s, farm, equipment, construction, logging, and other types of insurance policies. Additionally, we have written coverage opinions for insurance carriers and litigated coverage questions on behalf of insureds and insurance companies.
Lender Liability
When banking relationships go awry, the end result is often litigation. The bank is typically left needing to collect on the indebtedness, and many times the debtor believes the bank contributed to its financial problems. These claims usually take the form of misrepresentations by bank personnel, reliance upon past conduct by the debtor, unfulfilled promises, or simply disagreements about the nature of the banking relationship. Our firm has experience representing clients on both sides of these disputes.
Medical Malpractice
Qualified, devoted healthcare professionals are vital to our society. But when doctors, nurses, hospitals or other healthcare professionals are negligent it often results in life-changing injuries or death. In such cases, our firm works with reputable healthcare professionals to evaluate the level of care provided, and if merited, prosecute an action against the negligent health care professional to hold them accountable and obtain compensation for the victims.
Nursing Home Abuse and Malpractice
Our elderly family members depend on care from others. And it is disheartening to learn that instead of receiving the needed care, they were neglected —or worse, abused. Most common problems are malnutrition, falls, dehydration, pressure sores, infections, burns, and assaults. On behalf of nursing home residents –and their families–we aggressively investigate and pursue cases of neglect and abuse.
Personal Injury
When a person is injured by someone else’s negligence or wrongful conduct, the victim faces burdens and pressures from many sources. Often the injured person will miss work –maybe have to quit work or change jobs. Medical bills mount. The victim must endure medical procedures and suffer with the pain of the injury. Combined, these pressures lead to stress and mental anguish. The attorneys at our firm have experience handling injury cases related to motor vehicle accidents, slips and falls, premise liability claims, defective products, big truck accidents, alcohol related incidents, and other similar wrongful conduct.
Product Liability
Manufacturers and suppliers of products can be held responsible for the manufacture and sale of defective products which cause injury, death, or other damages to consumers. These cases involve a significant amount of product research and engineering expertise. Our firm has wide-ranging experience in product liability litigation. We have prosecuted and defended cases involving defective motor vehicles, home appliances, commercial equipment, farming equipment, guns, baptistery heaters, chemical products, and other similar products.
Real Estate
Attorneys at our firm are experienced in negotiations and transactional issues involving real estate and have handled a significant amount of real estate related litigation including condemnation actions, quiet title suits, property line disputes, adverse possession actions, and premise liability claims.
Utility Regulation, Communications and Cable Television
Our firm has handled a wide range of matters related to the regulation of telecommunications and electric utilities. We have represented a number of telecommunications and electric utilities before the Arkansas Public Service Commission and other regional public utility commissions. Our firm has also provided consulting services to various telecommunications, electric, communications, and cable television providers throughout the state.
Wrongful Death
The death of a loved one is often devastating –even more so, when they died because of negligence or wrongful conduct of another. Representing clients in wrongful death litigation requires the attorney to be knowledgeable of probate proceedings, statutory provisions related to wrongful death, damage theories, and the underlying cause of action. The combined and varied experience of our attorneys positions us well to handle the demands of wrongful death litigation. We have prosecuted and defended wrongful death actions related to car accidents, big truck accidents, medical malpractice, nursing home neglect and abuse, farm accidents, explosions, car fires, defective products, alcohol related incidents, and other similar actions.
